When you said you "sent the papers to the Ministry of Justice" you mean you have sent all the papers without having corresponding by emails beforehand to make sure you're eligible and that your case can be accepted?

Flavia, has sent an e-mail to the Ministry of Justice for me. But they just ask the date of death. They do not answer the question yet, so I sent the papers!

Looking the thread "Who has a Luxembourgish ancestor who died before 1.1.1900" I have read the history of Jim G, which is similar to mine, and the answer of the Ministry for him was positive. The marriage with a foreigner didn't desqualify her ancestor nationality.

If your case works out, and I believe it will, we can summarize the law by saying "Everyone who has a Luxembourgish ancestor born before 1.1.1900 has the right to recover their citizenship". Let's wait and see. I know another Brazilian woman who descends from one of Nicolas Bley's daughter who is also applying.

Isn't the main requirement of this whole thing that the ancestor was born before 1.1.1900?

This is waht the Ministere de la Justice wrote me in November/13 "Madame, Par la présente, j’accuse bonne réception de votre courrier électronique. Je vous confirme que l’aïeul Luxembourgeois au 1er janvier 1900 doit avoir été en vie en date du 1er janvier 1900. L’aïeul luxembourgeois décédé avant le 1er janvier 1900 peut avoir transmis la nationalité luxembourgeoise par filiation (droit du sang) à des descendants qui eux étaient en vie à la date préindiquée. Si ces descendants n’avaient pas perdu la nationalité luxembourgeoise avant le 1er janvier 1900, la condition prescrite par l’article 29 de la loi du 23 octobre 2008 pour recouvrer la nationalité luxembourgeoise serait remplie dans leur chef. Avec mes meilleures salutations."
With that I understand that you must have an ancestor that had the luxemburgish nationality on 1.1.1900, not just one who was born before 1.1.1900. Because your ancestor may have lost his/her nationality befopre 1.1.900.

Because your ancestor may have lost his/her nationality befopre 1.1.900" But, the Luxembourg government doesn't ask us for any naturalization documents (or proof of no naturalization) when we submit all of our paperwork. (If, for example, you were to attempt to be recognized as an Italian citizen, Italy does require naturalization documents or "proof" of no naturalization.) If the government isn't asking for this information, I doubt it is relevant to application. Moreover, Trevor, on his website, stated that he worried about his GG-grandmother having renounced her citizenship. Well, the Ministry of Justice asked me a CNN (certidão negativa de naturalização - Certificate of non naturalization) of my immigrant. Probably because he died before 1.1.1900. I had to prove he died as a Luxembourgish citizen. His son inherited his nationality and his son was alive on 1.1.1900. This is what I understood, at least.

I bet you had to jump through the additional hoop because he died before 1900.
If it was a standard requirement, it would be listed.
